#Bond Issues #americadiehl :
On Saturday September 18, 2021.
Just over a year after #Diehl was EXTRADITED BACK to Mecklenburg County from Colorado. We received an email informing us she had been released from jail. We immediately emailed the district attorney's office to inquire about the conditions of her bond.
On Monday September 20, 2021.
The district attorney's office informed us:
#Diehls attorney was able to clarify the Charlotte Mecklenburg Police Department would not be placing an ankle monitor on or monitoring #Diehl. Charlotte Mecklenburg Police do not monitor people with murder charges.
#Diehl had posted the $100,000 through a bond company. Was released without a monitor. Furthermore, she left the county and went to Clover South Carolina. There was no house arrest.
The Court had set bond with the conditions:
#Diehl was not to leave Mecklenburg County.
An ankle monitor would be in place. #Diehl would be under house arrest.
Nothing was going to be done about the fact that the conditions were not being met.
For us, the value of Mary's life was reduced to $10,000.
On Thursday September 23, 2021.
We hand delivered copies of the bond paperwork on #AmericaDiehl, from criminal records in the Mecklenburg County Courthouse, to our Victim/Witness Coordinator. We asked that it be delivered to the district attorney. We asked that our feelings about the violation of the conditions of bond be addressed. The district attorney's office put a bond hearing on the court docket for Wednesday the following week.
Wednesday September 29, 2021.
The district attorney's office told the judge that we were there to clarify conditions of( #AmericaDiehl) bond. #MarsysLaw gives victims the right to address the court regarding bond. We were able to address the fact that #Diehl left #MecklenburgCounty and the state. That she has no ankle monitor. Is not under house arrest. We were able to bring the paperwork to the judges attention. The judge inquired about these issues. Asking the attorney for #Diehl, Elizabeth Greene, if she had contacted the Clover Police Department regarding monitoring. She had not.
The judge directed the attorney to contact the Clover Police Department. The judge informed us that she was going to speak to CMPD regarding the ankle monitor policy. Another hearing was set for Friday of that same week.
Friday October 1st 2021
The judge was not pleased with the fact that CMPD is not monitoring murder related charges. That the State and the Attorneys continued to use it as a condition of bond, unaware it is not available. That was made very clear.
That our family had come to four bond hearings on #Diehl was also addressed. The judge expressed concern over #Diehls involvement in what was done to Mary. The judge imposed the following conditions on #AmericaDiehl :
A private company, paid for by #Diehl, will do ankle monitoring.
#Diehl has a curfew of 6pm to 6am.
Not to be out prior to 6am or past
6pm.
#Diehl is to have a psychological evaluation done within 30 days.
#Diehl is to have no contact with her codefendants.
#Diehl was allowed to remain in Clover, SC. Back to her home where she lived when Mary was Murdered.
We believe #Diehl broke the terms of her bond and should have been returned to the #MecklenburgCountyJail where she belongs. We have concerns about a company that #Diehl pays doing monitoring. We do not believe #Diehl should be out in the community at all.
As for psychological evaluation it's too late for that.
Mary is dead.
A hearing to revisit, as we understand it, to clarify #Diehl is adhering to the conditions of bond, Is set for December 9, 2021 at 10:30am in room 5310 at The Mecklenburg County Courthouse...
